WANTED FOR THE UNETHICAL "WALL OF SHAME"

Information to post on Unethical NH Attorneys, Guardian Ad Litems, Marital Masters, Judges or any other persons involved in "Judicial Child Abuse" or "Judicial Child Neglect." Please email details to nh.unethical.attorney@gmail.com. We will not post your identity or give out your personal information.

Message Board:

We need to keep the pressure on the NH Family Courts by educating the public about the numerous injustices occurring. Please feel free to send us your information for posting. I have not had any recent dealings with the court system so I do not have current information to post. The best way to deal with these unethical judges, guardian ad litems and lawyers is to post as much on them as you can so that people do not want to do business with them. I have personally known judges that have their own practices as most judges are attorneys first. Hit these people where it counts. Their wallets. Starve them out and cut off their funds. When people do not want to use their services, they will have to change their evil ways or be unemployed.

Who Is Rinaldo Del Gallo, III, Esq. – From The Website Of Berkshire Fatherhood Coalition

About Rinaldo Del Gallo (From The Webite Of The Berkshire Fatherhood Coalition)

Rinaldo Del Gallo, III, Esq. is the spokesperson of the Berkshire Fatherhood Coalition. He has been practicing family law attorney and has been a member of the Massachusetts bar since 1996. Mr. Del Gallo has handled a wide variety of family law cases including issues of child custody, child visitation, child support, restraining orders, grandparent visitation, contempt of family court, access to academic records, guardianship, allegations of abuse, criminal allegations related to domestic violence, disputes over the care of a child, and care and protection proceedings before the Department of Social Services.  For years, he has hosted bi-monthly free legal seminars for people of any gender having problems in family court.  On behalf of non-custodial parents, he has had made numerous media appearances in printed news, radio, and television. He has authored numerous family law related articles and columns.  He has performed extensive pro bono work for fathers.

Attorney Del Gallo also has extensive experience as a civil rights attorney, working in the areas of free speech rights and ballot access.  He was instrumental in protecting the City of Pittsfield from a zoning ordinance that would have allowed time-shares in any residential neighborhood, with a 15-page legal opinion that rebutted the assertion that time-shares was an impermissible regulation of ownership, not use, and thus was proscribed by law. This work was performed bro bono.

He is also an intellectual property attorney and a patent lawyer, and has written what is regarded as one of the most famous law reviews in the area of patent law, “Are Methods of Doing Business Finally Out of Business As A Statutory Exception?,”  that helped end the so-called “business method exception,” which paved the way for an entire field of software and Internet related patents.

Attorney Del Gallo graduated from Northeastern University (Boston) with a Bachelor of Science degree in Electrical Engineering, and graduated from George Washington University (Washington) in the top of his three-year class.

OK Legislator Blasts Family Law System; F & F’s Gregory Tells Committee ‘We Need Shared Parenting’ - From The "Fathers And Families" Website

OK Legislator Blasts Family Law System; F & F’s Gregory Tells Committee ‘We Need Shared Parenting’

November 8th, 2011 by Glenn Sacks, MA, Executive Director

An adult child of divorce, Rep. Jason Nelson criticized the courts for marginalizing his father.

Fathers and Families member Chris Gregory, a Marine combat veteran of Desert Storm and Somalia, recently told an Oklahoma House of Representatives committee that the family law system is rife with injustices and often separates children from the fathers they love and need.

Led by Representative Mark McCullough and Representative Jason Nelson, the Oklahoma House of Representatives conducted an interim study on family law and no fault divorce earlier this month. According to the legislators’ press release here, “Oklahoma’s family law is dangerously failing the children it is supposed to protect, leading some lawmakers to consider reform of both divorce statutes and the foster-care system.”

Corrupt judges get sued

Los Angeles, CA -- On June 15, at the Los Angeles Law Library, Dennis Ettlin and Daniel Cooper announce the filing of 8 civil law suits against 8 Los Angeles County judges. The 8 civil suits seek $38 million for civil rights violations and damages for prejudice against fathers. The lawsuits highlight judicial bias bought by L.A. County bribes and begin a fourth prong in the campaign to stop judicial bribes in California. The first effort by Judicial Watch succeeded with the Sturgeon I and II cases in getting the bribes ruled un-constitutional. The second effort, on April 13th, was the Judicial Watch demand for District Attorney Steve Cooley to seek the return of $350 million to the county.

The third prong is a legal challenge to void the orders of bribed judges.
The Appellate Court, in its Sturgeon II decision, called for this fourth effort. This first wave of law suits holds the judges personally liable for the loss of constitutional rights and for damages from the specific biases favoring Los Angeles County. All citizens of California are the victims of this “fraud on the court” and the biases perpetrated by judges.

The eight civil lawsuits name 5 L.A. Superior Court judges and 3 Appellate Court judges. Damages are sought for denial of the constitutional rights to due process and for specific damages due to biases in family law, traffic fines, domestic violence and gender discrimination. Our goal is to have a citizen jury re-affirm the illegality of the judicial bribes and to begin the process of compensating the victims. Further info is located at:

[Tenure of Office To Be Expressed in Commissions; Judges to Hold Office During Good Behavior, etc.; Removal.] The tenure that all commissioned officers shall have by law in their offices shall be expressed in their respective commissions, and all judicial officers duly appointed, commissioned and sworn, shall hold their offices during good behavior except those for whom a different provision is made in this constitution. The governor with consent of the council may remove any commissioned officer for reasonable cause upon the address of both houses of the legislature, provided nevertheless that the cause for removal shall be stated fully and substantially in the address and shall not be a cause which is a sufficient ground for impeachment, and provided further that no officer shall be so removed unless he shall have had an opportunity to be heard in his defense by a joint committee of both houses of the legislature.

Just read the cases of Johnson v. Johnson, Puiia v Miner, Whelen v Emerson, Miller v. Todd, and now Kenick v Kenick:

1. He recommended an order holding a father in criminal contempt following a hearing that had been noticed as a civil contempt hearing, which order resulted in that father, who was representing himself and was the primary custodian of the parties' minor child, to be incarcerated for 10 weeks, in contravention of his right not to be deprived of liberty but by the judgment of his peers, as guaranteed by Part 1, Article 15 of the New Hampshire Constitution.

Town Of Fitzwilliam, NH Recreation Department Coordinator Changes Her Position On Giving Legal And Biological Father A Schedule Of Soccer Games And Information On League Pictures After Dad Emails Towns Administrator Paula Thompson

This article is in regards to yesterdays posting regarding Julie Green the Town of Fitzwilliam, NH Recreation Department Coordinator emailing me and telling me that she could not provide me with a schedule of my son’s games or information on league pictures after I had explained that I am divorced and live out of state.

Green’s response was as follows:

“Unfortunately I am not able to furnish you with information. You will need to go through whatever channels you have set up with your family to acquire these details. It is beyond the scope of my position and authorization to be invoked in personal family matters.

I am sorry that I am not able to help you.”

WMUR News Nine in NH aired a special report on Thursday July 28, 2011 in regards to “Fathers Claim NH Courts Biased Against Them.”

We were all hopeful that Channel Nine News would report on the facts involving reasons why there are so many people speaking out about the NH Family Court System.  After all, last month Thomas Ball set himself on fire in front of the Cheshire County Superior Court (In Cheshire County the Superior Court acts as the family court since the state never funded a separate family division as every other county in the state appears to have done.  This means that the same Judges that hear criminal matters also are dealing with marital matters which are a major conflict).

"RALLY ON BEHALF OF CHILDREN AND FATHERS" NEEDS SUPPORTERS ON WEDNESDAY JUNE 22, 2011 AT THE CONCORD NH STATE HOUSE – READ LETTER BELOW FROM THE CONCORD MONITOR

LETTER

Rally on behalf of children, fathers

Thomas M. Mccarthy, Salem

The National Congress of Fathers and Children is having a sign rally at the State House on Wednesday.
June is National False Allegations Awareness Month, and we are demonstrating on behalf of the children of New Hampshire who have had their fathers torn from their lives due to false accusations. We are protesting the millions of dollars spent each year in the family courts at the expense of the taxpayers.
The family courts are bombarded with cases where a women merely has to say "I'm scared" and that's it. I, for one, have never harmed my family and never will, yet I am one of the hundreds of great fathers whom the state of New Hampshire has deemed unsafe to be with their own children. There was not so much as a thread of evidence produced against me stating otherwise.
The family courts are big business for lawyers, judges, doctors both mental and physical, visitation centers and all the staff members and associates involved with each one. Fathers are worthless in the eyes of these courts. The courts are designed to be used as a shield, while some women use them as a sword.

Man Sets Himself On Fire In Front Of The Entrance To The Cheshire County Superior Courthouse – It Appears Thomas Ball Sacrificed His Life In An Effort To Raise Awareness Of Issues With The Family Court System In NH And Around The Country - He Outlines These Issues In His “Last Statement” Which He Sent To The Keene Sentinel Just Prior To Losing His Life

Read The “last statement” Of Thomas Ball, courtesy the Keene Sentinel:

Last Statement
by Tom Ball

A man walks up to the main door of the Keene N.H. County Courthouse, douses himself with gasoline and lights a match. And everyone wants to know why.

Apparently the old general was right. Death is not the worst of evil.

I am due in court the end of the month. The ex-wife lawyer wants me jailed for back child support. The amount ranges from $2,200. to $3,000. depending on who you ask. Not big money after being separated over ten years and unemployed for the last two. But I do owe it. If I show up for court without the money and the lawyer say jail, then the judge will have the bailiff take me into custody. There really are no surprises on how the system works once you know how it actually works. And it does not work anything like they taught you in high school history or civics class.

Remembering Memorial Day

Dear Reader;
On Memorial Day it’s fitting to reflect on the sacrifices our friends, neighbors and fellow citizens have made as members of the Armed Services.  We repeatedly hear stories from members of the military expressing surprise and bewilderment that the country they swear to defend becomes the government that takes their children when they return home and face the family courts.

Testimony of Stevan Gressitt, M.D. On January 17th 2006 To "Committee On Children and Family Law" Again Gives Disturbing Account Of Issues With The NH Family Court System

I came across the second of Doctor Stevan Gressitt's testimonies on the NH Commission On The Status Of Men website at http://www.nh.gov/csm/pas_gressit.html.  This was testimony given in support of a 2005 house bill.  If you read the testimony, you will see that Dr. Gressitt identifies lots of issues with the family court system in NH.  Dr. Gressitt outlines how the current court system encourages parental alienation.  This testimony was given almost six years ago and today the same problems exist with the NH family courts.  Nothing has changed.

A 2008 Report From The NH Commision For The Status Of Men About Parental Alienation Syndrome

The Following is directly off of the 2008 report from the NH Commission For The Status of Men posted on the State's website.
_____________________________________________________

Parental Alienation Syndrome
During its February 2007 meeting, the Commission invited Dr. Stevan Gressit to talk about issues related to Parental Alienation Syndrome (PAS). Parental Alienation Syndrome is defined by Dr. Richard Gardner as

“a disorder that arises primarily in the context of child-custody disputes. Its primary manifestation is the child's campaign of denigration against a parent, a campaign that has no justification. It results from the combination of a programming (brainwashing) parent's indoctrinations and the child's own contributions to the vilification of the target parent."

A 2008 Report From The NH Commision For The Status Of Men - What About Dads?

The Following is directly off of the 2008 report from the NH Commission For The Status of Men posted on the State's website.

What About Dads?
One study from the Urban Institute found that most foster children were not living with their fathers at the time they were removed from their homes. While in foster care, these children may experience even less contact with their nonresident fathers. The study examined child welfare practices with respect to identifying, locating, and involving fathers of children in foster care and found that on resident fathers are often not involved in case planning, and nearly half were never contacted by the child welfare agency. See What About the Dads? at

In light of this finding, the Commission strongly recommends that the New
Hampshire Division of Children, Youth and Families identify and report to the legislature data regarding how many nonresident fathers they have attempted to contact and to what extent (number of attempts), and detail the methods of the attempts to contact them in order to participate in case planning for their child.

A 2008 Report From The NH Commision For The Status Of Men About The Importance Of Fathers

The Following is directly off of the 2008 report from the NH Commission For The Status of Men posted on the State's website.
_______________________________________________________

The Importance of Fathers
As stated in the Commission's previous report, lack of father presence has been linked to systemic problems such as poverty, high school dropout rates, crime, adolescent drug use, teenage pregnancy, and a higher demand for a variety of state-funded services. Worse still, children who grow up fatherless are more likely to commit suicide than those with a father present. (See "Father Facts," a compendium of research excerpts available via http://www.fatherhood.org)

According to Dr. Horn, one of the editors of the 2004 Father Facts booklet, it seems clear that children growing up without their father in the home face an increased risk of developing significant problems. This does not mean that all children who grow up in fatherless homes will encounter problems. Indeed, many of them will do just fine. But research indicates that fatherless children face more obstacles than those who grow up with both a mom and a dad, and are at greater risk for a host of developmental problems.

THE STATUS OF FATHERS

In a speech before the World Congress of Families, former director of the U.S. Administration on Children and Families, Dr. Wade Horn, stated that one out of every three children in America is living in a home without his or her natural father. One out of every three children in America will go to bed tonight without a father to read them a story, bring them a glass of water, kiss them good night, or comfort them if they have a bad dream.

Parental Alienation Condoned By Attorney Jaye L. Rancourt, GAL/Attorney Douglas A. Thornton, Marital Master David S. Forrest, and Judge John P. Arnold (Part 2)

(To Read Part 1 Click Here)

I think back to time when I would listen to Kenny Loggins song Return to Pooh Corner and proudly look upon my sleeping children.  The hard thing to get over is how Attorney’s like Jaye Rancourt, GAL’s like Doug Thornton, Marital Masters like David Forrest and Judges like John Arnold stole it all away from me by the roles they played in helping my ex-wife to alienate my children from me.  I have read from others that it’s like mourning for your children’s death but you know they are still very much alive.

These people are responsible for seeing that I will never get a chance to watch my children grow up.  They are the ones that played the biggest role in condoning my ex-wife’s parental alienation behavior by rewarding her.

I have heard some justify parental alienation by saying that it might just be a mother protecting her children, just as these corrupt people I am sure have justified it in their own minds.  What are these people protecting the children from?  I never abused my kids.  I was always there for them.  I was often complimented by my ex wife’s family for being the great dad until the divorce when my ex declared an all out smear campaign.  Then I was portrayed as incompetent and selfish.  A man that thought of their own needs before they thought of their children’s needs.  This is utter nonsense.

Was I selfish when I decided to put my foot down and tell my ex that I was tired of her years of abuse and I didn’t want the children to keep on being in the middle?  Was I selfish for wanting to get away from the physical abuse my ex-wife inflicted upon me?  Was I selfish when I had enough of my ex calling my friends, my family, her family and my boss and telling them I had a “Chemical Imbalance.”

Divorced Fathers with Visitation Orders Still ‘Powerless’ to See Children (From the website of Fathers and Families)

Here is a great article I found from the Fathers and Families website at http://www.fathersandfamilies.org/?p=11416.  I have been reading about this group.  They are very active in trying to get laws changed so that both parents have equal access to their children.

Divorced Fathers with Visitation Orders Still ‘Powerless’ to See Children

December 3rd, 2010 by Robert Franklin, Esq.

One point that Noam Chomsky has often made is that, if you want to get news and commentary that doesn’t tend to “manufacture consent” for existing policies and ways of framing issues, you need to put down the New York Times and pick up small regional or local publications.  They are, he’s said, more likely to provide information free of the filters elite opinion making requires.

Some time ago I reported on an excellent series in the Myrtle Beach Sun News on the Interstate Compact for the Placement of Children.  That was a good example of what Chomsky was talking about.  Here’s another (Goderich Signal Star, 12/1/10).

It’s a longish article about fathers and the trials - both actual and metaphoric - they face in the aftermath of divorce.  The piece considers three actual fathers, whom it calls Mike, Tom and Phil; its focus is the financial and emotional impact of losing custody and how the punitive nature of child support separates fathers from children.

All the villains are there; the piece describes a rogue’s gallery of anti-father bias.  For example, there’s domestic violence.

Tom and his then girlfriend had a falling out worse than most. A domestic assault left him with severe injuries to both his back and his jaw and unable to work. After both he and his girlfriend were charged in different assaults, she was granted custody of their son while he was put out in the street.

As with all the men interviewed, Tom’s access to his child is in the hands of the mother.  Yes there are court orders requiring her to allow him to see his child, but she violates them with impunity.

In his case, the mother of his child refused to sign a consent form, and as she had care and control of the child, there was nothing he could do. He’s scared to fight back, because any sort of aggression will only make his case worse.

“The worst part is, I’ve been there as a father,” he said. “But even my lawyer tells me to keep my mouth shut and bite my tongue. I never tried to argue – I just want access. I eventually had to call the police to get it.”

Now, he only wants to see his son regularly again, but it is getting increasingly hard, as the mother moved away from Huron County in direct contravention of their agreement.

On disability from his girlfriend’s attack, Tom can’t remotely afford an attorney to press his parental rights in court, so he is stuck with ever-diminishing contact with his child.

Phil, on the other hand, apparently has enough money to pay thousands of dollars to attorneys to fight for access to his child.  And over the years, he’s done just that and gotten court orders that supposedly allow him to see his son.  The result?  It took him nine months to get an order and another year before he was actually allowed to see the boy.  That’s 21 months in the life of a small child, which is to say, an eternity.

But even with yet another court order in hand, his parental rights still reside with her.

The worst part, Phil said, is that he has a court order to see his son, however, he is powerless even if the mother of the child continues to violate the agreement. Rather than the courts making the mother obey the court order, he said, he has to go through the whole process from the beginning.

The courts answer to the mother’s violation of one of its orders is not to order her to pay costs, not a fine, not a change of custody and not jail for contempt of court; it’s another order.  He must go again to court, get another order which she can then comply with or not as she desires.

As Australian academic John Hirst wrote in his essay, “Kangaroo Court,” alone among courts and only in the case of visitation orders, family courts refuse to enforce their own orders.  In no other situation does a court abandon its power to enforce its own dicates.

The result of course is that custodial parents, in Canada 90% of whom are mothers, are free to ignore visitation orders, and in many cases they do.  They know they won’t be punished or lose custody, so why let the dad see his kids?  Thus are fathers removed from or marginalized in their children’s lives.

The article ends by returning to the tragic 1995 case of Andrew Renouf.  Destitute in part due to paying child support, and unable to see his child, Renouf was driven to suicide.

A single father who was cut off from his daughter for four years, Renouf’s suicide note described a situation where his paycheck garnishing left nothing to live on. By the time his pay reached his bank account, he literally had 43 cents to his name.

This is the system of family law we live with.  It’s a system that all too many find perfectly satisfactory and that they defend tooth and nail.  It’s a system fully capable of destroying non-custodial parents, and depriving children of their fathers.  It’s a system built on myths, principally those of the dangerous dad and the deadbeat dad.  That essentially all reputable social science debunks those myths, and has for decades, is apparently of no importance.

Recently I read an article by the redoubtable warrior Donald Dutton.  It was a piece about the myths perpetuated about men and domestic violence, and he pointed out something I’d never thought of before.

Dutton wrote that courts and the legal profession generally make much of what is and isn’t good science.  Courts are ever wary of what they sometimes call “junk” science, i.e. that without sufficient data, methodology or scientific rigor.  And when they find such deficient science, they hasten to exclude it as evidence, rightly refusing to allow it to support or rebut one side’s case.

Dutton’s point was that, given the great value they supposedly place on good science, it’s odd that, in the case of domestic violence, courts routinely rely on the shoddiest work in the field.  And what’s true of DV is equally true of the value of fathers to children.

And yet, with all the science on the side of fathers and the value of them to children, and with all the pontificating about the “best interests of the child,” courts still obstruct fathers’ access to their children.  As countless studies, and by now a wealth of societal experience, have shown that’s the worst of junk science.

“So we beat on, boats against the current…”
